FOLTARA / PRIVACY & IMAGE RIGHTS
Your images.
Clear choices.
Privacy notice updated 12 October 2026. This notice covers the account, planning and image-creation services currently available.
Who is responsible+
Martins Raiens Lācis, trading as Foltara, is responsible for Foltara's account, support, security and service administration. You can contact [email protected] or +371 22098292 for privacy questions or rights requests. Business users must also ensure their own collection and use of photos and people's likenesses is lawful.
Information we use+
Account information includes email, verification status and the profile fields you choose to provide. Service information includes your brief, selected photos, image requests, results and saved cloud copies. Billing records identify purchases, balances, refunds and disputes; card details go directly to Stripe. Security information includes request timing and pseudonymous mailbox, browser and network signals used to limit repeated trials and abuse. Support includes the information you choose to send us.
Why and on what basis+
We use account and service information to provide the service you request and manage your account; this is necessary to perform our contract with you or take steps you request before a contract. We use proportionate security and abuse checks for our legitimate interests in protecting customers, the service and funded trial capacity. Billing and tax records are also retained to meet legal obligations. Optional advertising or public showcase use requires separate permission; uploading a photo is not marketing consent. Do not include sensitive information that the service does not need.
Before uploading a person or someone else's work+
Use photographs and artwork you own or have authority to process with Foltara and OpenAI. Authorisation must cover the photograph, protected artwork and an identifiable person's likeness where applicable. Person references must show authorised adults. A clear selfie or everyday photo can be a reference; no identity document is needed. Do not upload private documents, children, intimate material or photos obtained merely by finding them on Pinterest or a retailer's page.
What leaves your device+
Selected references and your written brief can be sent to OpenAI for reference checks, safety checks and image creation. Foltara uses Supabase for accounts and private server data, Railway for hosting, Cloudflare for delivery and security, Resend for account emails, and Stripe for payments when enabled. These providers receive information needed for their respective roles. Foltara does not sell your photos or account data. Uploaded camera metadata is removed before reference storage; original provider PNG downloads are preserved without re-encoding when available.
Device drafts and cloud copies+
A local brief stays in this browser; person photos are excluded from persisted local drafts. Save cloud copy creates a separate private account copy of the brief with clothing and setting references, excluding person photos and generated results. These explicit cloud copies remain until removed through your account or a deletion request. Removing a photo from a draft does not erase an existing server generation record. Download images and export briefs you want to keep.
How long generation files last+
Foltara's hosted generation references normally expire after seven days for clothing, setting and inspiration photos, and after one day for person photos. Server results normally expire after 30 days. Expired objects are removed by maintenance; operational delays can defer actual deletion. Expiry may prevent a later refinement. Account, billing, security and generation activity records have separate purposes and can remain after photo expiry. OpenAI's own processing and retention are separate: zero data retention is not promised.
Provider locations and safeguards+
Service providers may process information outside Latvia and outside the European Economic Area, including in the United States. Their data-processing terms and applicable transfer safeguards govern those transfers; relevant provider privacy and data-control links are below. Contact Foltara for information about the safeguards applicable to your service use. Supplying a photo does not authorise its unrelated reuse or public release.
Your rights and choices+
Depending on the applicable basis and law, you can request access, correction, deletion, restriction or portability and object to processing based on legitimate interests. You can withdraw separate optional consent without affecting earlier lawful processing. Account settings provide export and cloud-copy deletion controls; contact Foltara for requests they do not cover. We may need proportionate information to verify account ownership, but never your password. We normally answer data-rights requests within one month; lawful billing retention and other applicable exceptions can limit deletion.
Security checks and complaints+
Automatic safety and trial checks may refuse or pause a particular request; contact Foltara if you believe the result is wrong. These checks do not guarantee that all abuse or image errors are prevented. You can complain to Latvia's Data State Inspectorate (Datu valsts inspekcija) or another competent supervisory authority. Essential account storage and browser draft data support the service; optional analytics are not a condition for using it.
Publishing a result+
Review the result's clothing details, likeness, framing and applicable disclosure requirements before publishing. Private sample permission is separate from public advertising rights. Foltara does not gain permission to publish your uploads or private results merely because you created an image. An illustrative photoshoot is not evidence of measured fit, physical product condition or a real person's endorsement.
